SumIs – Terms of Use

1. Acceptance of Terms

By accessing or using the SumIs app, you acknowledge that you have read, understood, and agree to be bound by these Terms of Use and our Privacy Policy. If you do not agree to these Terms, you must not use the App.

We reserve the right to modify these Terms at any time. We will notify you of any material changes by posting the new Terms on this page and updating the "Last updated" date. Your continued use of the App after such modifications constitutes your acceptance of the updated Terms.

2. Description of Service

SumIs is a mobile puzzle game application that allows users to solve number-based puzzles, compete with other players in real-time matches, participate in leaderboards, and create private matches with friends. The App is available for iOS and Android devices.

We reserve the right to modify, suspend, or discontinue any aspect of the App at any time, with or without notice, without liability to you or any third party.

3. Eligibility

You must be at least 13 years of age to use this App. If you are under 18 years of age, you represent that you have obtained parental or guardian consent to use the App. By using the App, you represent and warrant that:

• You are at least 13 years old;
• You have the legal capacity to enter into these Terms;
• You will comply with all applicable laws and regulations when using the App;
• All information you provide is accurate, current, and complete.

4. User Accounts

4.1 Account Creation

You may create an account to use certain features of the App. Accounts can be created anonymously or through social media login (e.g., Facebook). You are responsible for maintaining the confidentiality of your account credentials.

4.2 Account Security

You are responsible for all activities that occur under your account. You agree to:

• Keep your account credentials secure and confidential;
• Notify us immediately of any unauthorized use of your account;
• Ensure that you log out from your account at the end of each session;
• Not share your account credentials with any third party.

4.3 Account Termination

You may delete your account at any time through the App settings. We reserve the right to suspend or terminate your account if you violate these Terms or engage in any fraudulent, abusive, or illegal activity.

5. User Conduct

You agree to use the App only for lawful purposes and in accordance with these Terms. You agree NOT to:

• Use the App in any way that violates any applicable local, state, national, or international law or regulation;
• Attempt to gain unauthorized access to the App, other accounts, computer systems, or networks connected to the App;
• Use any automated system, including "bots", "spiders", or "offline readers" to access the App;
• Interfere with or disrupt the App or servers or networks connected to the App;
• Transmit any viruses, malware, or other harmful code through the App;
• Impersonate any person or entity or misrepresent your affiliation with any person or entity;
• Harass, abuse, threaten, or harm other users or engage in any behavior that is harmful, offensive, or inappropriate;
• Cheat, manipulate, or exploit bugs or glitches in the App to gain an unfair advantage;
• Reverse engineer, decompile, or disassemble any portion of the App;
• Use the App for any commercial purpose without our prior written consent.

6. Intellectual Property Rights

6.1 Our Rights

The App, including its original content, features, functionality, design, graphics, logos, and software, is owned by VoidEdge Apps and is protected by international copyright, trademark, patent, trade secret, and other intellectual property laws.

You acknowledge that the App contains proprietary and confidential information. You may not copy, modify, distribute, sell, or lease any part of the App or included software, nor may you reverse engineer or attempt to extract the source code of that software.

6.2 Your Content

You retain ownership of any content you create, upload, or share through the App (such as usernames, profile information, or in-game content). However, by using the App, you grant us a worldwide, non-exclusive, royalty-free, perpetual, irrevocable license to use, reproduce, modify, adapt, publish, translate, and distribute such content for the purpose of operating and promoting the App.

7. In-App Purchases and Virtual Items

The App may offer in-app purchases, including virtual items, currency, or premium features. All purchases are final and non-refundable unless required by law or as otherwise stated in these Terms.

Virtual items and currency have no monetary value and cannot be exchanged for real money, goods, or services. You do not own virtual items; you purchase a limited license to use them within the App.

Prices for in-app purchases may vary by location and are subject to change without notice. All purchases are processed through third-party payment processors (Apple App Store, Google Play Store), and you agree to their terms and conditions.

8. Leaderboards and Competitions

The App features leaderboards and competitive gameplay. We reserve the right to:

• Remove or disqualify any user from leaderboards if we suspect cheating, fraud, or violation of these Terms;
• Reset leaderboards or scores at any time for maintenance or fairness purposes;
• Modify scoring algorithms, game mechanics, or competition rules at any time;
• Cancel or modify competitions, tournaments, or events at any time.

9. Privacy

Your use of the App is also governed by our Privacy Policy, which explains how we collect, use, and protect your personal information. Please review our Privacy Policy to understand our practices. By using the App, you consent to the collection and use of your information as described in the Privacy Policy.

10. Disclaimers

10.1 App Availability

We strive to provide a reliable and enjoyable experience, but we do not guarantee that the App will be available at all times, uninterrupted, secure, or error-free. The App may be unavailable due to maintenance, updates, technical issues, or other reasons beyond our control.

10.2 No Warranty

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR COURSE OF PERFORMANCE.

We do not warrant that the App will meet your requirements, that the operation of the App will be uninterrupted or error-free, or that defects in the App will be corrected.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL VOIDEDGE APPS, ITS AFFILIATES, DIRECTORS, OFFICERS, EMPLOYEES, AGENTS, OR LICENSORS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM:

• Your use or inability to use the App;
• Any unauthorized access to or use of our servers or your data;
• Any interruption or cessation of transmission to or from the App;
• Any bugs, viruses, or other harmful code transmitted through the App;
• Any errors or omissions in any content or for any loss or damage incurred as a result of the use of any content posted or transmitted through the App.

Our total liability to you for all claims arising out of or relating to the use of or inability to use the App shall not exceed the amount you paid us, if any, for accessing the App in the twelve (12) months prior to the claim.

12. Indemnification

You agree to defend, indemnify, and hold harmless VoidEdge Apps, its affiliates, directors, officers, employees, agents, and licensors from and against any claims, liabilities, damages, losses, and expenses, including without limitation reasonable attorney's fees, arising out of or in any way connected with:

• Your access to or use of the App;
• Your violation of these Terms;
• Your violation of any third-party right, including any intellectual property or privacy right;
• Any content you submit, post, or transmit through the App.

13. Third-Party Services

The App may contain links to third-party websites, services, or resources. We are not responsible for the availability, accuracy, or content of such third-party services. Your interactions with third-party services are solely between you and the third party, and we are not liable for any loss or damage arising from such interactions.

The App may integrate with third-party services such as:

• Social media platforms (e.g., Facebook) for login and sharing;
• Advertising networks (e.g., Google AdMob, Facebook Audience Network);
• Analytics services (e.g., Firebase);
• Payment processors (e.g., Apple App Store, Google Play Store).

Your use of these third-party services is subject to their respective terms and conditions and privacy policies.

14. Termination

14.1 Termination by You

You may stop using the App at any time by uninstalling it from your device. You may also delete your account through the App settings.

14.2 Termination by Us

We may terminate or suspend your access to the App immediately, without prior notice or liability, for any reason, including if you breach these Terms. Upon termination, your right to use the App will cease immediately.

14.3 Effect of Termination

Upon termination, all licenses and rights granted to you under these Terms will immediately cease. Sections of these Terms that by their nature should survive termination shall survive, including but not limited to intellectual property rights, disclaimers, limitations of liability, and indemnification.

15. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of India, without regard to its conflict of law provisions. Any disputes arising out of or relating to these Terms or the App shall be subject to the exclusive jurisdiction of the courts located in Jaipur, Rajasthan, India.

If you are located in the European Union, you may have additional rights under applicable consumer protection laws.

16. Changes to Terms

We reserve the right to modify or replace these Terms at any time at our sole discretion. If we make material changes, we will notify you by:

• Posting the updated Terms on this page;
• Updating the "Last updated" date;
• Sending you a notification through the App (if applicable).

Your continued use of the App after any such changes constitutes your acceptance of the new Terms. If you do not agree to the new Terms, you must stop using the App.

17. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary so that these Terms shall otherwise remain in full force and effect and enforceable.

18. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and VoidEdge Apps regarding the use of the App and supersede all prior agreements and understandings, whether written or oral, relating to the subject matter hereof.
